These Terms of Service ("Terms") apply to your use of this website and to any towing, recovery or roadside assistance service you request from Cleveland Towing And Recovery ("we," "us," or "our"). By requesting service, you agree to these Terms.

Services we provide

We provide light, medium and heavy duty towing, flatbed towing, winch outs and recovery, accident and collision recovery, roadside assistance (jump starts, flat-tire changes, fuel delivery and vehicle lockouts), truck decking and undecking, long distance towing and junk vehicle removal across Southeast Tennessee and North Georgia.

Requesting service and authorization

You can request service by calling us or by submitting the request form on our contact page. Submitting the form is a request, not a confirmed booking — a job is scheduled once we have spoken with you. When you request service you confirm that you are the owner of the vehicle or are otherwise authorised to have it moved, and that you have the authority to allow us onto the property where it sits. If a vehicle is on private property, the person who controls that property must have authorised the removal.

Quotes and pricing

We quote a price before we dispatch, normally a hook-up (base) charge plus a per-mile rate, with winch outs and recovery work quoted according to the situation. A quote is based on the information you give us. If the actual conditions turn out to be materially different — for example, the vehicle is somewhere other than described, will not roll, or needs additional recovery work — we will tell you what changes before we carry on.

Payment

Payment is due when the service is completed unless we have agreed otherwise in writing. You receive an itemized receipt showing the date, the pickup location, the destination and the charges broken out.

Cancellations

Call us as soon as you can if you no longer need the truck. If we have already dispatched and arrived, a call-out charge may apply.

Your vehicle and personal property

We handle every vehicle with care and use equipment and methods appropriate to it. Please remove valuables and important documents before we take the vehicle. We are not responsible for personal property left inside, for pre-existing damage or mechanical condition, or for damage that could not reasonably be avoided given the vehicle’s condition or where it was situated.

Limitation of liability

To the fullest extent permitted by law, our liability arising out of any service is limited to the amount you paid for that service. We are not liable for indirect, incidental or consequential losses, including lost wages, missed appointments or rental costs. Nothing in these Terms limits any liability that cannot be limited under applicable law.

Estimated arrival times

Any arrival time we give you is an honest estimate, not a guarantee. Traffic, weather, road closures and the number of calls ahead of yours all affect it. If something changes we will tell you rather than leave you waiting.

Website use

The content of this site is provided for general information about our services and may change without notice. Descriptions of services are not offers of a fixed price; pricing is quoted per job when you call.

Changes to these Terms

We may update these Terms from time to time. Changes take effect when posted on this page, with the "Last updated" date revised accordingly.

Governing law

These Terms are governed by the laws of the State of Tennessee, without regard to its conflict-of-laws rules.

Cleveland Towing And Recovery operates a text messaging program so customers and prospective customers can reach us and receive service updates. These SMS terms form part of these Terms & Conditions.

• Program description and message types. Messages relate to the service you asked us about: replies to your questions, quotes and estimates, appointment confirmations and reminders, arrival and job-status updates, invoices and receipts, and follow-up about work we have completed for you. We do not send recurring marketing or promotional text campaigns.
• How you opt in. You consent to receive text messages by giving us your mobile number and asking us to contact you — for example by submitting a request form on this website, by ticking a text-message consent box where one is provided, or by texting us first at (423) 457-5553. Consent to receive text messages is not a condition of purchasing any goods or services.
• Message frequency. Message frequency varies and depends on your conversation with us and on any active or upcoming job.
• Message and data rates. Message and data rates may apply, depending on your mobile carrier and plan. Cleveland Towing And Recovery is not responsible for charges from your carrier.

• Carrier liability. Mobile carriers are not liable for delayed or undelivered messages. Delivery depends on effective transmission by your mobile carrier.
• Supported carriers. Our program is supported by major mobile carriers in the United States. Carriers are not responsible for the content of messages.

No mobile information will be shared with third parties/affiliates for marketing/promotional purposes. Information sharing to subcontractors in support services, such as customer service, is permitted. All other use case categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

The mobile information you share with us, and your text messaging consent, are handled as described in our Privacy Policy.

Privacy
